A prenup signed before the wedding is a straightforward notarial process — no court involvement, no publications, no creditor notifications. If you marry without a prenup and want to change your marital regime later, you will need a postnuptial contract, which requires a High Court application and costs between R15,000 and R25,000. Getting your prenup right before the wedding saves you tens of thousands of rands.
Most of our clients complete the entire prenup process from home — no need to travel to Pretoria. Here is how it works, step by step:Step 1 — Apply online. Complete our application form at www.antenuptialcontracts.co.za/apply. It takes a few minutes. Tell us about your circumstances so we can recommend the right prenup for you.
Step 2 — We draft your prenup. We prepare a pro forma prenup based on your instructions, typically within 24 to 48 hours. We email it to you for review. If you want any changes — different accrual ratio, specific asset exclusions, a donation clause — just let us know and we adjust it at no extra cost.
Step 3 — Sign and return. We send you the prenup together with a power of attorney. Both parties sign the power of attorney before a commissioner of oaths (available at most police stations, banks and accounting firms) and courier it back to our office. There is no need to travel to Pretoria — the vast majority of our clients complete the entire prenup process remotely. If you prefer to sign in person at our office, you are welcome to do so.
Step 4 — We execute and issue your certificate. On receipt of the signed power of attorney, our Notary Public executes the prenup on your behalf and immediately issues a certificate for your marriage officer. Your wedding can proceed — you do not need to wait for Deeds Office registration.
Step 5 — We register. We lodge your prenup at the Deeds Office for registration. Once the original is returned from the Registrar of Deeds, we notify you. You can collect it from our office or we can Postnet or courier it to you.

Signing: Most clients sign the power of attorney before a local commissioner of oaths and courier it to our office — no need to travel to Pretoria. If you prefer to sign in person, you are welcome to visit our office.

Deeds Office registration: The contract must be registered within three months of execution. We handle this entirely on your behalf.We have completed prenups on the morning of a wedding. While we recommend starting the process as early as possible, it is never too late — right up until the ceremony.
No. A prenup must be signed before the marriage is solemnised. This is a firm legal requirement — there are no exceptions.However, if you are already married without a prenup, the law does provide a way to change your marital regime through a postnuptial contract.
This requires a joint application to the High Court under Section 21(1) of the Matrimonial Property Act. The process involves notifying creditors, advertising in the Government Gazette and two newspapers, and obtaining a court order.
